PARADOXALITY OF CONSTITUTIONALIZATION TO RIGHT TO HEALTH

Resumen: The health constitutionalization is directly related to the democratization process in Latin America starting from the 80s. In the following decades we lived, as stated by Bobbio, “an era of rights”, where most of the social demands became social rights. However, we still lack the right to be entitled to such effected rights. This article has the scope to discuss the limits and possibilities of the right to health in a highly complex and paradoxical society. We never had so many rights, and that is because these rights are not made effective; there is an exclusion in the same proportion as the assertiveness of the same rights.
